Rs 3,000 Cancer Drug Sold for Rs 27,000: SC Flags Massive Markups
Justice Sandeep Mehta, sitting with Justice Vikram Nath, highlighted the large price gap while hearing petitions concerning drug pricing, including one filed by advocate Kishan Chand Jain. The bench questioned why medicines could not follow a uniform rule capping the maximum retail price at 16 per cent above the price to the retailer, referring to the same margin used under the Drug Price Control Order. The court also questioned why essential medicines should be excluded from the DPCO when medicines and medical devices fall under the Essential Commodities Act. The bench criticised corporate hospitals for requiring patients to purchase medicines exclusively from in-house pharmacies, observing that such practices can leave patients with limited choice. The court also raised concerns about the financial burden created by inflated medicine prices when patients receive treatment under government health schemes, as higher medicine costs can affect public expenditure. The court had raised a similar concern on September 22 regarding a cancer drug supplied to retailers at around Rs 2,700 but reportedly sold to patients for Rs 27,000. Some reports quoted the bench using strong language to describe the pricing practices, while the Solicitor General reportedly described the proposed 16 per cent cap as a logical approach. The court's observations came during the ongoing proceedings and do not by themselves constitute a final ruling on the issue.
